The tennis star had been forced to stay in a detention hotel in Melbourne after being blocked by border officials last week ahead of the Australian Open.
A judge this morning freed him from immigration detention after accepting he had provided border officials with a medical certificate exempting him from a rule that non-Australians must be vaccinated against Covid.
However, uncertainty remains over whether he really will be allowed to stay because immigration minister Alex Hawke has personal powers to ignore the court ruling and rip up his visa again. It is expected he will make a decision in the coming hours.
