Though the reasoning in the order by a single-member bench of Justice SR Krishna Kumar was not immediately available, it has brought cheer to the gaming industry. The government is likely to appeal, though a final decision will be taken after a review of the order.
The government has been vocal against the alleged large-scale tax evasion in the fast-growing industry. The high court had previously stayed the show cause notice issued by the DGGI, which was the largest ever tax demand on any online gaming company.
At present, an 18% GST is levied on online gaming on the platform fee. A group of state finance ministers had recommended 28% rate for casinos, horse racing and online gaming, but could not arrive at a consensus on whether in the case of online gaming, the tax should be levied on just the fees charged by the portal or the entire consideration. Another point of contention has been whether to have differential tax treatment for games of skill and games of chance.
