The order was passed by a bench headed by Chief Justice of India (CJI) Sanjiv Khanna on an appeal filed by the state government against the November 12 decision passed by the high court. The order under challenge had struck down a 2006 law under which these appointments were carried out and directed consequential action of disqualification to follow against 6 Congress MLAs appointed to these posts in January last year.
