THE Madras High Court has upheld the powers of the state GST authorities to block the electronic cash ledger (ECL) of any errant firm that faces action for wrongfully availing input tax credit (ITC), until the investigation is completed.
"The negative blocking is well within the scope of provisions of Rule 86A of GST Rules," Justice Krishnan Ramasamy said in a recent order passed while dismissing the writ petitions filed by Chennai-based Skanthaguru Innovations Pvt Ltd.
The petitions, filed by J Arun Balaji, the authorised representative of the company, prayed for quashing the notice in Form ASMT-10 issued on September 26 by the Commercial Tax Officer, Thiruvallikeni circle, blocking the electronic credit/cash ledger, and to unblock the ledger.
