
Hyderabad: The Constitution is silent on a timeframe for gubernatorial assent or rejection of a bill and at least 40 bills are pending approval with Raj Bhavans of Telangana, Tamil Nadu and Kerala. This has in fact triggered a debate on whether a deadline should be set for governors to express their views on bills.
Statute experts differ in their opinion. While some argued for setting guidelines, others sought discussions between governments and Raj Bhawans. They attribute the current stalemate to Constitution's Article 200 (governors dealing with bills) silence on a timeframe for governors.
The Constitution states that a governor has the authority to grant or deny assent immediately under Article 200. The governor may also reserve the bill for consideration by the President, who can take the final call. Another option is to return the bill to the legislature for reconsideration of a specific provision or of the bill in entirety. The governor may also propose amendments.
