Mumbai: Observing that BMC had clearly abused its power, the Bombay high court on Friday allowed the Uddhav Thackeray-led Shiv Sena to hold its annual Dussehra rally on October 5 at Shivaji Park.
“In our view the decision taken by municipal corporation on the applications in this manner is not a bona fide decision,” said Justices Ramesh Dhanuka and Kamal Khata. They allowed the petition filed by Shiv Sena and its secretary, MP Anil Desai, and quashed and set aside BMC’s September 21 order refusing permission to the Uddhav faction to hold its rally at the ground. The BMC had denied permission to both factions of the Sena citing a police report that raised law and order concerns.
The HC verdict comes as a shot in the arm for the embattled Uddhav camp at a time when it is fighting a case in the Supreme Court and before the Election Commission against the Shinde faction over who constitutes the real Shiv Sena.
