New Delhi: The Supreme Court on Wednesday refused a plea for an immediate ban on demolition drives in UP and some other BJP-governed states, saying encroachments on public land and illegal structures were not immune from action under municipal laws even as it adjourned to August 10 the detailed scrutiny of Jamiat Ulama-I-Hind’s plea against ‘selective’ bulldozing of houses of accused in stone-pelting and rioting cases in UP.
Responding to the plea of Jamiat that the use of bulldozers to bring down houses of one community was violative of the rule of law, a bench of Justices B R Gavai and P S Narasimha said: “No one can dispute that the rule of law should prevail but under the municipal laws, authorities may take action against unauthorised constructions. Can we pass an omnibus order to restrain authorities?” The Justice Gavai-led bench assured the petitioners that it would examine the issue and listed Jamiat’s petition along with other applications for hearing on August 10.
