New Delhi: Senior advocate Kapil Sibal, leading the charge against IPC Section 124A, told the Supreme Court on Tuesday that both Jawaharlal Nehru and Mahatma Gandhi were dead against retaining the sedition provision, widely used by the British to arrest freedom fighters, in statute books.
Solicitor general Tushar Mehta said though that were the views of the first Prime Minister, nothing was done to re-examine its necessity for more than 70 years after India became a republic.
"We are carrying out an exercise which should have been done 70 years ago," he said. The exchange of fire between the former UPA government minister and senior advocate Sibal and the SG took the advocates in the CJI's courtroom on a brief historical journey during which the two seasoned lawyers resorted to one-upmanship.
