Allahabad High Court Criticises UP Additional Chief Secy For Seeking Exemption Appearance To Attend Programme With CM

The Allahabad High Court in the case observed and has taken exception to an affidavit filed by the Additional Chief Secretary (Finance), UP Govt pleading for exemption from the court's presence, the ground being that he was required to attend a Programme to be attended by the Chief Minister.

The bench headed by Justice Salil Kumar Rai in its order stated that the proceedings initiated by the court are not supposed to be delayed because of the Programme fixed by any other constitutional authority, in which the contemnor considers his presence to be necessary.

The single judge in the case was hearing the contempt petition filed by Laxman Prasad Kushwaha in 2009 for non-compliance with the order of High Court wherein the court directed the authorities to sanction his salary and salary arrears.
