The Supreme Court in the case The State Of West Bengal Ad Ors. Versus Rebeka Khatun Molla @ Rebeka Molla And Ors observed and has stayed the order of Calcutta High Court wherein the court directed CBI probe into allegations of custodial torture of 2 women arrested amid protests that took place in West Bengal after the RG Kar Medical College rape-murder incident.

The bench comprising of Justice Surya Kant and Justice Ujjal Bhuyan was hearing the present matter.

The bench in the case issued notice wherein the petition is filed by the State of West Bengal challenging the High Court order.

The court asked the counsel, Senior Advocate Kapil Sibal appearing for the State Government to submit a list of IPS officers (which includes the women officers), who can be included in a Special Investigation Team, SIT to investigate the custodial torture case instead of CBI.

In the said case, 2 women were participants in the Nabanna Abhijan march, held following the RG Kar Medical College incident.
