“It is inherent that a person holding public office should maintain restraint. It is an unwritten rule and a part of Constitution culture and they should not blabber something which is disparaging and affects a section of people,” Justice Nagarathna said.

Though agreeing that it is not acceptable for public functionaries to shoot from the hip, the Centre impressed upon the court to let Parliament take a call. Attorney general R Venkataramani and solicitor general Tushar Mehta told the bench that the apex court has given two verdicts on petitions filed by Tehseen Poonawala and Amish Devgan on the issue and in the light of those judgments there was no need to hear the case. They said that the questions framed in the case are abstract and it would be problematic to pass order on those issues.
