Nagpur: The Nagpur bench of the Bombay HC Friday acquitted wheelchair-bound ex DU professor GN Saibaba and four others of aiding and abetting Naxal activities and waging war against the state, declaring "null and void" proceedings in the Gadchiroli sessions court since 2014 that cuIminated in their life sentence under the UAPA five years ago. A sixth convict, who died this August while serving 10 years, was also acquitted.
"While the war against terror must be waged by the state with unwavering resolve... a civil democratic society can ill afford sacrificing the procedural safeguards legislatively provided... at the altar of perceived peril to national security," the high court said.
‘EVERY SAFEGUARD MUST BE ZEALOUSLY PROTECTED’
May 9, 2014: Saibaba arrested and produced before court, remanded to judicial custody
Dec 14, 2015: Sessions court orders joint trial of Saibaba, 5 other accused
March 3, 2017: Saibaba, 4 others get life; 1 gets 10 years (dies in jail in Aug ’22)
Oct 14, 2022: Nagpur bench of Bombay HC acquits Saibaba and 4 other convicts
Sessions Trials 30/2014 and 130/2015 are null and void in the absence of valid sanction under Section 45(1) of UAPA...We are inclined to hold, that every safeguard, however minuscule, legislatively provided to the accused, must be zealously protected —Bombay HC
