New Delhi:
The Supreme Court on Tuesday directed real estate major Supertech to demolish two 40-storey towers additionally constructed in one of its housing projects in Noida after holding that the construction was done in violation of law and in collusion with the Noida authority, whose erring officials were also directed to be prosecuted.
A bench of Justices D Y Chandrachud and M R Shah held that construction of additional towers comprising around 1,000 flats were in contravention of rules and buildings regulations, including safety and fire norms, and directed the company to raze them within three months at its own cost. It also directed the builder to refund money to all homebuyers who had booked flats in the twin towers, which are unoccupied and still under construction with up to 32 floors having been completed so far. The order is the outcome of a 9-year battle by the residents’ welfare association of Emerald Court against the builder for building additional towers in the green area in violation of rules and blocking sunlight and air for other towers. The firm said it will seek review of the order.
