In the present case, the petition is filed by Dheeraj Wadhwan for bail on medical grounds, who had moved the high court after the Special Judge, PC Act Rouse Avenue Court denied him medical bail in its order dated May 24.
A single bench of Dr. Justice Sudhir Kumar Jain while granting bail to Dheeraj Wadhwan stated that even though Wadhwan may not require hospitalization at the moment, but he needs 'regular and periodical medical attention" and treatment under 'direct supervision of expert and specialist doctors', hence falls within the ambit of a sick person under Section 437(1) of the Code of Criminal Procedure, CrPC.
The petition filed before the High Court contended that that Wadhwan suffers from multiple comorbidities and chronic ailments including ischemic heart disease, chronic kidney disease, fluctuating serum creatinine levels, hypertension, obstructive sleep apnea, obesity etc.
It has also been stated by Dheeraj Wadhwan before the high court that during his judicial custody since April 26, 2020 Wadhwan had visited the hospital about 50 times and he has undergone around 8 surgeries.
