The Bombay High Court on Tuesday revived a 2013 suo motu (on its own) PIL highlighting bad conditions of city roads considering “public welfare and public importance”. The court, meanwhile, disposed of the contempt petition filed by a lawyer alleging non-compliance with the 2018 HC orders by civic authorities to repair potholes along all arterial roads in the city and Mumbai Metropolitan Region (MMR).
A bench of Chief Justice DK Upadhyaya and Justice Amit Borkar revived the PIL saying: “Taking into consideration public welfare and public importance of the directions in the light of recognition of fundamental right under Article 21, Public Interest Litigation No 71 of 2013 stands revived.” It added that citizens have a fundamental right to streets and footpaths in reasonable condition and the civic authorities are obligated to ensure that streets and footpaths are maintained in a condition that allows citizens to use them effectively.
