Political parties cannot consider election symbols their "exclusive property" and the right to use them can be lost if their poll performance is dismal, the Delhi high court has held.

The HC's observations came as it dismissed an appeal by Samata Party against the poll panel's allotment of the "flaming torch" symbol to the Uddhav Thackeray faction of the Shiv Sena for the November 3 Andheri East bypoll. A single judge HC bench had earlier upheld the allotment.

Samata Party claimed the "flaming torch" belonged to it and that it had contested elections on the symbol.
