The well-intentioned column by Bibek Debroy and Aditya Sinha (‘Vacation pe Vacation’, TOI, October 1, https:// bit.ly/3g0I2xX), while arguing against vacations for the higher judiciary, does not quite capture the true nature of duties discharged by a judge and the functioning of the judiciary.
The column appears to proceed on the erroneous presumption that the wheels of justice grind to a halt during the period of court vacations. The term ‘vacation’ is deceptive – for it only means that the daily hearing of cases in the courtroom is restricted to a few judges.
However, contrary to the impression created, the Indian justice delivery system is never truly ‘vacated’. The impression of court vacations seems to be that judges indulge in an extended siesta during this period – a portrayal that could not be further from the truth.
