All India Judicial Services- Need Of The Hour

On September 28, 1789, George Washington in a letter to Attorney General Edmund Randolph wrote, “Impressed with a conviction that the due administration of justice is the firmest pillar of good Government, I have considered the first arrangement of the Judicial department as essential to the happiness of our Country, and to the stability of its political system; hence the selection of the fittest characters to expound the laws, and dispense justice, has been an invariable object of my anxious concern.”

Although Washington’s letter and conviction had nothing to do with Indian judiciary but it reflects the kind of impetus we need to make All India Judicial Service a reality. Indian Judiciary the simulacrum of integrity of the largest democracy of the world has always brought a sense of gratification to people of India. For years, it has been the stalwart of justice. The Judges of this country not only proved their excellence in delivering unbigoted judgements but also served as the bacon light for candid justice dispensation by applying their jurisprudential wisdom. The efficacy of any system would depend upon the quality and virtue which would be exhibited by the members of the said system. Judges thus play the pivotal role in the justice dispensation system of our country. Thus it has become pertinent that the appointments of Judges are made in an impartial manner and on the basis of merit. All – India Judicial Service has thus become an indelible necessity from a mere demand.

Builders Can't Force Buyers To Go For Arbitration

It is a well settled law that arbitration agreements do not bar the jurisdiction of the National Consumer Disputes Redressal Commission (‘NCDRC’) and other consumer forums. The issue was, however, reconsidered at length by a Full Bench of the NCDRC, in Aftab Singh v Emaar MGF Land Limited &Anr [Consumer Case No 701 of 2015] in view of the amendments to the Arbitration and Conciliation Act 1996 (‘the Amended Act’).
