The Gujarat High Court on Monday declined to grant relief to an individual who challenged a notice issued by the Gujarat Housing Board (GHB) to remove/demolish a mosque/ Ibadat Gah built on the common plot of a residential colony in Bhavnagar. <p>As per the case details, Harun Malkani filed a petition challenging the GHB's notice to the residents of Memon Colony at Bharatnagar in Bhavnagar in July this year. He submitted that he occupies a property built by the GHB in 1980 for people from the Lower Income Group (LIG). A mosque was built in 1989 on the common plot with the consent of the residents as they did not have a place to offer religious prayer in the colony. The petition said the residents pay all the taxes and electricity bills yet the GHB has issued them a notice. It further said they are ready to regularise the construction under GRUDA Act. </p><p>However, the HC declined to grant any relief after hearing arguments by Government Pleader GH Virk. The pleader said the colony was built by the GHB and its land is given on leasehold rights. The common plot of the colony is not to be used other than for residential purposes. As per the provisions of the GRUDA Act, Virk said, any illegal construction on the land belonging to the government, local authority or statutory body cannot be regularised. Therefore the petition needs to be rejected. AM</p>
