Delhi High Court: Mere govt recommendation does not entitle individual to claim DDA plot area of choice, allotment subject to availability

The Delhi High Court in the case Shri Rashter Kumar vs.Delhi Development Authority & Anr. observed that an individual cannot claim a particular plot of land in a particular area of his choice as a matter of right, even if recommendations are being made by a government authority or by an agency for allotment of alternate land to the individual.

A single Judge Bench of Justice Dharmesh Sharma in the case was considering the petitioner's prayer for allotment of land measuring 400 square yards, which is based on the recommendation letter of the Land and Building Department.

In the present case, the land belonging to the predecessorin-interest of the petitioner in Nangli Jalib village, New Delhi came to be acquired. The predecessor-in-interest applied for allotment of the alternative plot. Therefore, he passed away when his application was pending.
