In a relief to the state government, the Centre, BMC, railways and a couple of private parties, the Bombay HC on Wednesday held that fraud was committed on the court and set aside a 2020 consent terms decree which had given all rights over 6,000 acres covering 279 plots, including 120 hectares at Kanjurmarg proposed for the Metro car shed, to Adarsh Water Parks and Resorts Pvt Ltd.

Mumbai: The state, Centre, BMC and railways showed HC documents and revenue records and submitted they were owners of large sections of the land. The HC said, "The consent term was result of a fraud." 

HC: Consent decree void & suit will have to be reheard

Mumbai: A decree by consent was granted last October in a 2006 suit filed by Adarsh Water Parks and Resorts Pvt Ltd against Abdul Rashid Yusuf and others in a dispute over ownership of 6,000 acres, including land at Kanjurmarg.

The state's additional government pleader Himanshu Takke sought setting aside of the decree on the grounds that it was obtained by committing a fraud on court by not making the government a party despite it being owner of 1,800 acres of that land. However, the state had filed the application in March, months after two other private parties, Apex Constructions and Jolly Anil India Pvt Ltd, lessees of the state for a part of the land, had petitioned the HC seeking quashing of the consent terms decree.
