New Delhi: The Supreme Court on Tuesday designated the Delhi high court to take a call on the validity of contentious 'Agnipath' scheme for soldier recruitment to three wings of armed forces and transferred all PILS before it to the HC with a direction for an expeditious decision. Solicitor general Tushar Mehta convinced a bench of Justices D Y Chandrachud, Surya Kant and AS Bopannanotto diminish the vast jurisdiction of the high courts under Article 226 and 227 of the Constitution to entertain PILS and decide the validity of policy decisions of governments.
"Several PILS are pending in the high courts in Delhi, Kerala, Punjab and Haryana, Patna and Uttarakhand. The Centre can file a petition in the Supreme Court seeking their transfer to one HC, which the court can request for a time-bound decision. The apex court can have the benefit of a considered view of the HC,” Mehta pleaded.
