The last budget session of Parliament was one of its most productive sessions in a quarter century. The passage of a huge number of bills, long hours of debate and the participation of almost 80 per cent of MPs was, by all accounts reason for a celebration. That, however, was miles away from what happened on ground. A curfew in a state while passing a bill, shoving activists in vans protesting against an amendment, recurrent walkouts by the opposition, none of this really stopped the ruling government from getting its bills passed. While one can surely not complete the number and nature of human rights violation cases observed in India in a breath or 10, what remains important is the selective silence observed by the commission in cases of mass violations? Legal Notes' October issue dwells at length on the quality of justice being delivered. The cover story looks at the case of Prempal Singh, a common labourer, who was falsely accused by the police simply because he picked up enough courage to help a woman in distress. He was beaten, humiliated and was forced to do the rounds of the court to clear his name. And for all his years of waiting, he was given a princely amount of Rs 8.5 lakh. On the other is, once again, ISRO scientist Nambi Naraayanan, who was falsely accused of espionage. His battles against the police to clear his name took 24-odd years - after which he was given a compensation of Rs 50 lakhs.
There is also a report on the Public Interest Litigation that has been filed to bring clarity in the regulations of transport of mortal remains from abroad by air. The magazine looks at how technology is slowly making inroads in the judicial process - although hiccups do exist.

Legal Notes August 2018 pieces together l'affaire Justice Adarsh Kumar Goel that is tearing the country apart. This follows the controversial directives passed by the judiciary this year that included a change in the guidelines for arresting a person under the SC/ST Atrocities Act. In March this year, a SC bench of Justice Adarsh Kumar Goel (now retired) and Justice U U Lalit laid down guidelines to protect public servants and private employees from "arbitrary" arrest under the 1989 Scheduled Castes and Tribes (Prevention of Atrocities) Act. Soon after his retirement was announced, Justice Goel was appointed as the National Green Tribunal Chairman that has been opposed by Cabinet Minister Ram Bilas Paswan. His reason: "The (appointment of a) judge who ruled against" the SC/STs would send a "wrong message". LN finds out if it is really the job of a cabinet minister to mobilise other members of a house, to remove judges from their positions considering they gave a directive that failed to appease a certain section of the society?
There is also the larger question that a brute majority disliking particular judgments but electorally critical minority could begin a similar agitation to topple judges simply because they disliked particular verdicts or it did not suit their interests.
