20,000 SC/ST GOVT EMPLOYEES DEMOTED IN KARNATAKA TO IMPLEMENT SUPREME COURT ORDER
Over 20,000 government employees belonging to Scheduled Caste and Scheduled Tribes categories have been demoted after the State government started implementing the Supreme Court order that revoked reservation in promotions.
The order was made in the case BK Pavitra and others vs Union of India. BK Pavithra, a government engineer working in the Bengaluru Development Authority (BDA), had challenged the concessional seniority given to SC and ST employees in promotions.
The Supreme Court ruled in Pavithra’s favour and asked the Karnataka government to stop caste based reservation for government posts, which goes all the way back to 1978.
UNCERTIFIED CDRS NO EVIDENCE: JUDGE
Though the Central Bureau of Investigation(CBI) collected call data records (CDR) of several persons, including those arrested in the case and critical witnesses, with no certification from the concerned authority, the evidence became useless. The printouts of CDRs pertaining to various telephone numbers were declared during investigation by the CBI, which was the first investigation agency in the Mecca Masjid blast case, during trial. However, it was found that these documents were signed by the investigation officer himself and they were not certified by any competent authority like service provider. It was on these mobile phone devices and various SIM cards the investigation agency first made the breakthrough and later CBI declared that the Mecca Masjid blast was part of a larger conspiracy. At least, he could have examined the ATS officer, but he failed to do so. Then, the source of getting the CDRs has not been proved,” the order said.

Builders Can't Force Buyers To Go For Arbitration
It is a well settled law that arbitration agreements do not bar the jurisdiction of the National Consumer Disputes Redressal Commission (‘NCDRC’) and other consumer forums. The issue was, however, reconsidered at length by a Full Bench of the NCDRC, in Aftab Singh v Emaar MGF Land Limited &Anr [Consumer Case No 701 of 2015] in view of the amendments to the Arbitration and Conciliation Act 1996 (‘the Amended Act’).
