In a recent case involving allegations of rape under the false promise of marriage, the Gujarat High Court expressed concern over the increasing number of consensual sex relationships being weaponised as rape accusations. This trend mirrors the rise in cases under the Domestic Violence Act and Section 498(A), where relationships turn sour and accusations fly. The court quashed an FIR against a young man accused of rape by a 19-year-old woman who had become pregnant and given birth. A DNA test proved that the accused was not the child's biological father. The court noted that the DNA report completely falsifies the case of the prosecution.
