RANCHI: The Jharkhand High Court sentenced two police officials to one month simple imprisonment and imposed a fine of Rs 2,000 on each of them for arresting two Myntra employees, a logistics arm within the Flipkart Group of Companies, without serving them notice under Section 41-A of the CrPC, which is required before arresting an accused booked in the sections in which maximum quantum of punishment is seven years imprisonment.
The court also awarded Rs 50,000 cost to each of the employees to be paid by the erring police officials. Apart from this the high court also gave the employees opportunity to avail themselves of other remedies available in law for claiming compensation for wrongful arrest by police.
A high court advocate close to the matter said the order came on Tuesday after the court heard a contempt petition filed by Instakar employees, who were sent to jail after their arrest on February 28 this year. They stayed in jail till March 16 when the lower court granted them bail.
"Division bench of chief justice MS Ramachandra Rao and Justice Deepak Roshan gave the order on Tuesday. The petitioners had filed a petition saying their arrest was a violation of judgment rendered by the Supreme Court in Arnesh Kumar Versus State of Bihar & Others in (2014) 8 SCC 273 as well as the judgment rendered in Satender Kumar Antil Vs. Central Bureau of Investigation, in (2022) 10 SCC 51," the high court advocate said, sharing the order copy.
