Court opens compensation route for homes threatened by invasive weed

Homeowners will now be able to claim damages from adjoining third party landowners if ‘pernicious’ Japanese knotweed has encroached on their property.

The landmark ruling from the Court of Appeal found in favour of two adjoining householders from Maesteg, south Wales, who had been fighting an appeal by Network Rail after an earlier and successful damages claim against the national rail transport provider and landowner in Cardiff in February last year.
