The Judicial Officer was also charged for acting arbitrarily by not forwarding Ahlmad's appeal seeking promotion.
The bench comprising of Justice Sureshwar Thakur and Justice Sudeepti Sharma in the case found that the testimonies of the Court staff needs to be recorded by the enquiry officer for proving charge was not sufficient to prove that the judicial officer used abusive and derogatory words against the Ahlmad. The Division bench in the case observed and has found that no evidence could be found on record that the Judicial Officer with ill-will and malice did not forward the appeal of the Ahlmad wherein seeking promotion for ten months.
