In a significant development, the Supreme Court has overturned its 2022 verdict declaring as unconstitutional two provisions of the law on benami property.
One of the provisions, Section 3(2) of the law, had provided for a three-year imprisonment for those who had entered into benami transactions between September 5, 1988, and October 25, 2016. This meant that a person could be sent behind bars for a 'benami' transaction entered into 28 years even before the section came into existence. The previous bench had said that the provision was violative of Article 20(1) of the Indian Constitution.
