The legislation never intended that a developer or any third party, who seeks to carry out redevelopment on a plot owned by a public body or Government for their personal gain, should be allowed to claim exemption merely because the land belongs to government or such body, said the bench of Justices R D Dhanuka and Kamal Khata.
The bench dismissed 103 petitions filed mainly by builders and housing societies with development or redevelopment projects across the city on civic or state land. The petitioners had challenged notices issued by public bodies for payment of development charges. The cumulative amount in these notices is estimated at Rs 800 crore.
