Pocso: 3-yr RI as molestation in crowd alarming, says court

Mumbai: Observing that such incidents cause alarm in the minds of people and show that girls are not safe in society even when surrounded by many, a special Pocso court on Wednesday convicted and sentenced a 32year-old man to three years’ rigorous imprisonment for molesting a 16-year-old girl while she was boarding a Titwala-bound train at Dadar station in 2019.

“The incident has taken place in a very crowded area. There is a very adverse impact of the incident on the victim girl, her family members and society,” special judge Priya P Bankar said.

While the accused, Kalwa resident Omhari Singh, had claimed that the teenager’s top was such that it was difficult to put one’s hand under it, the court noted that as it had straps, it was very easy to insert the hands inside it. “The said act of the accused shows that he has the intention to outrage the modesty of the victim. He knowingly and intentionally inserted his hand inside the t-shirt of the victim. The act itself is sufficient to show that it is done with sexual intent,” the special judge said.
