Justice Nirzar Desai of the Gujarat High Court on Monday dismissed a petition filed by controversial Chartered Accountant Tehmul Sethna in a case related to fraud in a trust. He had challenged the state's move to drop a key witness in the cheating case during its trial.Sethna was arrested and later convicted on the basis of a cheating complaint filed by Shivangi Panchal, 55, Trustee of Environment and Research Development Centre. As per the case details, following the death of Shivangi's father Pannalal Modi in 2006, Sethna won her confidence to run the trust. He allegedly opened an account in the trust without the knowledge of Shivangi and her sister Parul Modi, also a trustee. He then carried out financial transactions worth Rs6.85 crore through this account.During the trial the prosecution dropped Modi as a witness. Later Sethna was convicted for five years in the case.
