Clarifies Court of Board of Nominees after Malabar County-2 home owner objects to demand for transfer fee
Nikunj Soni
Service soc has no right on property

In a significant decision, a court of the Board of Nominees has ruled that cooperative housing service societies do not have any ownership rights or interest in the property bought by a home buyer.

Consequently, such societies cannot claim a stay order against the occupancy or possession of a flat purchased by a home buyer in case of a dispute over non-payment of transfer fees. This ruling has brought relief to a home buyer who purchased a flat in the Malabar County-2 Cooperative Housing Service Society.
