Jagtar Singh Johal, from Dumbarton, was there for his wedding in 2017 when accused of being involved in a political murder plot.
An investigation by the UN Working Group on Arbitrary Detention found there was no legal basis for his imprisonment.
But the 36-year-old has remained in prison facing the death penalty.
The supreme court of India yesterday upheld a high court decision and granted bail in one of the nine cases against Johal.
His legal team will now move ahead with other applications. His brother, Gurpreet Singh Johal, said: "This is light at the end of the tunnel that Jagtar could potentially be released."
