Les Brown, former head of the Crown Office unit which oversaw the probe into Sheku Bayoh's death, told an inquiry it risked any investigation into police involvement leading up to the death of the 31-year-old who was restrained by six officers in Kirkcaldy on May 3, 2015.
Yesterday, the Sheku Bayoh inquiry heard that police were in charge of the case at the time of the postmortem. The next day, the Police Investigations and Review Commissioner took over a probe into the events leading up to his death.
Mr Brown said: "There is&nbsp;a risk that independence would be compromised."
The inquiry also heard details about the cause of death were shared with officers who attended Hayfield Road, where he was restrained, before they gave statements.
The inquiry before Lord Bracadale in Edinburgh is examining the lead-up to the death and whether or not race was a factor.
