Last month, lawyers for the 60-year-old argued he had been "vindicated" by the Special Criminal Court, after he was acquitted of the murder of Kinahan associate David Byrne.
They claimed there was "no strong, valid ground" he should not have his costs paid by the State.
But Ms Justice Tara Burns said despite the not guilty verdict, it was not unfair to deny him his legal costs due to other relevant considerations.
At the hearing over the legal costs on June 7, Ms Justice Burns ruled there was "a reasonable possibility that nothing was carried out by the Hutch Organised Crime Group without his say so". She said that while the veteran crime figure was cleared of the murder of Byrne at Dublin's Regency Hotel in February 2016, "The Monk" was known to be the "patriarchal figure" of the Hutch gang.
She added: "He was involved in serious criminal conduct underlying the charge against him and he was in possession of the guns from the Regency which he knew had been used to murder David Byrne."
