<p>The Limerick man was beaten to death with a brick and a baseball bat at the US home he shared with wife Molly and his two children.</p>
<p>Molly, 39, claimed unprecedented publicity over the 2015 killing now threatens her right to a fair trial.</p>
<p>Judge David Hall said he would make a decision by Friday whether to move the trial to Winston-Salem, from Davidson County.</p>
<p>The accused appeared in court on Friday with members of Jason's family, who had travelled from Ireland for the hearing.</p>
<p>Lawyers for the Martens argue the two cannot receive a fair trial in the county where the couple lived because some residents have indicated their allegiance lies with Jason's family.</p>
<p>Publicity prompted Judge Hall to issue a gag order on the participants in the case, lest it taint the jury.</p>
<p>A jury convicted Molly and her father Tom, a 72-year-old former FBI agent, of second-degree murder in August 2017.</p>
<p>In August 2021 the Court of Appeals overturned the convictions. The retrial will start on June 26.</p>
