The Mumbai crime branch has invoked the Maharashtra Control of Organised Crime Act (MCOCA) in the Baba Siddique murder case. The stringent Act has been applied to all 26 arrested accused. Notably, confessions made to the police under MCOCA are admissible as evidence in court, and it is difficult for the accused to obtain bail under it.Besides the arrested accused, three suspects are wanted in the case - Shubham Lonkar, Zeeshan Akhtar, and jailed gangster Lawrence Bishnoi's brother, Anmol Bishnoi, who is now under arrest in the US. The MCOCA has already been invoked against him.The MCOCA has been enacted by the Maharashtra government to combat organised crime and terrorism; the Delhi government also implemented it in 2002. The law covers cases of organised crime such as extortion, kidnapping for ransom, murder, attempted murder, threats, and any large-scale illegal activities generating significant money.The Act grants the state special powers to address these issues, including enhanced surveillance capabilities, relaxed evidentiary standards, procedural safeguards, and the imposition of additional criminal penalties, including the death penalty.The accused in the Siddique murder case were arrested from across the country - Punjab, Haryana, Uttar Pradesh and parts of Maharashtra, including Pune. The prime accused, Akashdeep Gill, was arrested from Punjab. Gill was allegedly in contact with the mastermind, Anmol Bishnoi, and was identified as being responsible for the logistical coordination of the murder plot orchestrated by Bishnoi.On November 10, Shiv Kumar and four other suspects were arrested by a joint team of the Uttar Pradesh Special Task Force (STF) and the Mumbai crime branch from Bahraich.Bishnoi has applied for political asylum in the US where he has been arrested for using forged documents to cross over from Canada. He was arrested a few days ago in Sacramento, California, and is currently being held at Pottawattamie County Jail in Iowa.After Siddique's fatal shooting on October 12, the FIR was registered under Sections 103(1) (murder), 109 (abetment of a crime), 125 (act endangering life or personal safety of others), and 3(5) (general explanations) of the Bharatiya Nyaya Sanhita (BNS), along with Sections 3 (possession or carrying of firearms or ammunition), 5 (sale or transfer of arms or ammunition without a license), 25 (forcibly taking firearms), and 27 (using arms) of the Arms Act, and Sections 37 (carrying arms) and 135 (disobeying a lawful order) of the Maharashtra Police Act.
