A LEGAL case about whether Plymouth's Armada Way trees were chopped down unlawfully has been thrown out of court. A High Court judge yesterday dismissed a judicial review brought by the action group Save the Trees of Armada Way (Straw).
On the second day of the hearing, Judge David Elvin KC said he did not consider the circumstances rounding the decision by Plymouth City Council to cut down 129 trees in March last year "to be exceptional".
Speaking to The Herald from London's Royal Courts of Justice, a Straw spokesperson said: "It's deeply disappointing." Plymouth City Council's legal team successfully argued the case was "academic" as it had already withdrawn the decision.
