Mumbai: A &lsquo;contract marriage&rsquo; may seem like a desi jugaad to obtain the green card faster. Or so it appeared to Dishant Patel, 24, and Shweta Patel, 23, both Indian citizens living in Indiana in the US, who didn&rsquo;t think twice before entering into fraudulent marriages for a quicker route to a green card.
Unfortunately for them, in what could well be a plot for a Bollywood potboiler, the persons they entered into matrimony with turned out to be undercover law enforcement officers who were out there to catch couples entering fraudulent marriages to obtain US citizenship.
While the total processing time for obtaining US citizenship on the basis of marriage, which falls in preference category 2A, could run up to a few years, it&rsquo;s still much faster than the employment route to green card which takes decades. At times, even those already living in the US succumb to this fraudulent practice.
The Department of Justice also detailed other cases. Vishal Kamal Chhabria, a licensed attorney based in Lake Forest, Illinois, has also pleaded guilty. Between April 2018&nbsp;and March 2022, Chhabria provided legal representation to fraudulently married couples when they applied to the US Citizen and Immigration Services for a green card for the foreign national spouse.
He assisted the couples in completing necessary forms with false representations, gathering, manufacturing and submitting false documentation, coaching the couples to falsely hold themselves out as legitimately married and evade detection by officials during the green card interviews. He also personally accompanied them to these interviews. The attorney is&nbsp;now scheduled to be sentenced in a US court on March 16, 2023.
Delina Shaw, based in Connecticut, played the role of a marriage broker, connecting Indian nationals seeking the green card with US citizens willing to enter a fraudulent marriage for payment. She charged thousands of dollars for each marriage that she facilitated. Perhaps she ran out of suitable US citizens and in April 2018, herself entered into a &lsquo;contract marriage&rsquo; with an Indian male citizen.
Getting married just to receive immigration benefits is a federal crime in the US.
