The Supreme Court on Tuesday dismissed the Enforcement Directorate's appeal seeking cancellation of bail granted to NCP member and ex-Maharashtra home minister Anil Deshmukh in a money laundering case, for which he has already been in jail since his arrest on November 2 last year.
Solicitor general Tushar Mehta attempted to show the alleged extortion of money from various bars and restaurants&nbsp;by police allegedly on the orders of then home minister and subsequent routing of Rs 1.7 crore through 40 shell companies to Nagpur-based Shri Sai Shiksha Sansthan, of which Deshmukh was the chairperson.
However, the trial of evidence got tinged with the unreliability of the evidence provided by approver and dismissed cop Sachin Waze, which was highlighted by&nbsp;Deshmukh's counsel Kapil Sibal and accepted by a bench of Justices DY Chandrachud and Hima Kohli.
The bench also considered the health conditions of Deshmukh, who was reportedly rushed to Jaslok hospital on Monday and has been advised angiography, and said it would not interfere with the Bombay HC decision to grant bail to Deshmukh, but clarified that the HC observations in the bail order would not be relevant for trial purposes.
Justice NJ Jamadar of the&nbsp;HC had said it was "unsafe" to rely on Waze's statement that he had collected money from among 1,750 orchestra bars in Mumbai and delivered it to Kundan Shinde (co-accused and Deshmukh's PA) at instructions of Deshmukh. The HC had granted bail to Deshmukh on furnishing a bail bond and surety of Rs 1 lakh on October 4. The HC had, however, stayed the implementation of its order till October 13 after the ED submitted it will challenge the order in the Supreme Court.
