Can't ascribe motive to judge, says SC, issues contempt notice

Observing that judges are not infallible and can pass wrong judgements that can be corrected, the SC on Friday said that this does not allow parties to attribute motive to a judge, adding it will not tolerate parties scandalising the court.

Sending out a stern warning to lawyers that they cannot get away after making allegations while challenging their orders, an SC bench issued contempt notice against two lawyers for attributing motive to MP HC chief justice who passed a judgment against the petitioner.

New Delhi: Sending out a stern warning against making remarks about a judge’s motive, a bench of Justices Sanjay Kishan Kaul and Abhay S Oka told advocate M L Sharma who was appearing for the petitioner, “We are deeply troubled with the ground raised by the petitioner in the petition. It is an endeavour to scandalise the high court by alleging that for unduly favouring the society (party opposing the petitioner) and raising the issue of judicial misconduct.
