Bareilly:&nbsp;The court of MP/MLA sessions judge Alok Dubey on Thursday dismissed senior Samajwadi Party (SP) leader Azam Khan&rsquo;s plea challenging his conviction in a hate-speech case that led to his disqualification from the UP assembly.
Soon after the court's decision, the Election Commission (EC) released a press note with more details of the by-poll schedule. The voting in Rampur will be held on December 5 and the last day of nomination is November 18.
&ldquo;The Election Commission of India will issue a gazette notification on November 11 as per the directions of the Supreme Court,&rdquo; the EC note said.
Former district government counsel Arun Prakash Saxena told TOI: &ldquo;After directions from the apex court,&nbsp;the district court had preponed (advanced) the hearing against conviction in this matter from November 15 to November 10. After hearing the arguments of both the parties, district judge rejected Azam Khan&rsquo;s application.&rdquo;
Azam&rsquo;s counsel Imran Ullah Khan said, &ldquo;We had pressed a stay application against conviction in the MP/MLA sessions court. We had mentioned the consequences of not providing a stay in this case. This court has delivered its judgment on the stay against conviction. The final argument on the appeal against&nbsp;the lower court is still pending.&rdquo;
BJP member Akash Saxena, who&nbsp;pursued the case in court via his counsel, said, &ldquo;The court's decision has paved the way for a by-poll in Rampur.&rdquo; The MP/MLA court in Rampur had earlier convicted Azam in a hate speech case and awarded him three years of jail. Azam was subsequently expelled from the UP House.
