Chandigarh: Convicts incarcerated in Haryana&rsquo;s jails are not be deprived of parole or furlough on &ldquo;mechanical orders&rdquo; based on &ldquo;apprehension of breach of peace&rdquo;, the state has told concerned officials.

The Haryana government has asked the authorities, including deputy commissioners (DCs), division commissioners, the state police, and the prison department, to display a &ldquo;humanistic&rdquo; approach while deciding such applications.
Instructions regarding this have been issued by the Haryana chief secretary&rsquo;s office on October 20, relying on the directions passed by the Punjab and Haryana high court in April this year to reduce the number of cases filed by convicts against the rejection by the local authorities of their cases for release on parole/furlough.
Convicts in Haryana seeking temporary release from jail on parole or furlough will not any longer be declined such relief merely by citing &ldquo;apprehension of breach of peace&rdquo;. Sources in the chief secretary&rsquo;s office said the directions have been passed in compliance with the April 22, 2022 order in the Phool Kumar versus State of Haryana case.
In that case, a high court&nbsp;division bench headed by Justice G S Sandhawalia had observed that declining parole only due to the apprehension of breach of peace was not justified but authorities in the state were continuously passing such mechanical orders, resulting in the HC having to deal with such case on a regular basis.
&ldquo;In such circumstances, we are of the considered opinion that the state needs&nbsp;to have a re-look at the issue and issue necessary instructions to the concerned officials to deal with these issues on a regular basis,&rdquo; the division bench had held.
The bench had ordered a copy of the judgment to be sent to the Haryana chief secretary for necessary circulation in concerned quarters so that a more humanistic approach was taken by them while dealing with such applications and the burden of this court could be reduced.
The HC had passed these orders while allowing a plea filed by a convict in a drug case. His plea for parole was declined by the Rohtak divisional commissioner on the basis of a police report apprehending a breach of peace if he was paroled. However, during the examination of the records, the HC found that the petitioner convict had already availed of parole on several occasions and had reported back to jail on time.
