New Delhi: Noting the inordinate delay&rdquo; in receiving the Lokayukta reports from Delhi government, lieutenant governor VK Saxena has written to chief minister Arvind Kejriwal, advising him to ensure such statutory reports were tabled in time in the assembly to strengthen&rdquo; the state ombudsman system.
While approving the 16th and 17th annual consolidated reports of the Lokayukta of Delhi for the years 2017-18 and 2018-19 for laying before Delhi Assembly, the LG noted that he had received these from the CM&rsquo;s office after a delay of three years.
Such a delay deprived the assembly of taking cognisance of these important reports deal with corruption, abuse or misuse of position in cases of public functionaries, an LG office source said, adding that laying of annual reports before the legislative assembly ensured that the suggestions and the recommendations made by the Lokayukta were debated for further strengthening of the ombudsman system.
&ldquo;I would like to advise the ministers concerned to please be guided appropriately to dispose of such important matters of the public interest within a reasonable period, so that the statutory purpose of laying it before the legislative assembly is not defeated and Delhi is not deprived of its wisdom,&rdquo; the LG wrote to the CM.
Reacting to the letter, Delhi government said the LG was ac ting like a school headmaster&rdquo;.
Sources said the Lokayukta had submitted the reports to the LG on October 1, 2019 and these were sent to the chief secretary&nbsp;on October 23 for explanations to be offered by the Kejriwal government as per the Lokayukta Act, 1995. The reports, said officials, highlighted the constraints being faced by the Lokayukta in terms of its independence, powers, financial-autonomy,machinery for conducting investigations and jurisdiction, among others.

While the administrative reforms department submitted the explanatory memorandum to the minister-in-charge on September 22, 2020, it reached the CM two years later on September 19 this year. The CM sent it for LG&rsquo;s approvalon September 27.
&ldquo;It is unfortunate that these important reports are not taken seriously and dealt with in a very casual manner,&rdquo; the LG&rsquo;s letter said.
While asking the CM to recall that such delays were brought to his notice on earlier occasions too and the matter placed in the assembly, Saxena wrote, Being the custodian of public trust, it is incumbent upon higher public functionaries to display appropriate alertness in such matters of public importance.&rdquo;.
Sources said that in his letter, the LG also highlighted various concerns raised by the Lokayukta in the reports. While the Act empowers the Lokayukta to summon any person and examine him under oath, the Delhi counterpart neither has such powers nor has investigative machinery at his disposal. The Lokayukta also raised the matter about the absence of financial autonomy, lack of independence to recruit staff, absence of jurisdiction over civil servants and powers to examine charges against them.
