In South Africa, if you’re 16 years or older, you can choose the beneficiaries of your possessions after your demise. Should you die without a will, South African law stipulates who your heirs will be. Before drafting your will, the following should be kept in mind.

Marital status

Your marital status will determine legislative implications when leaving assets to anyone other than your spouse. For example, if you’re married in community of property, you and your spouse’s assets will form part of your deceased estate and your spouse will, by law, be entitled to 50% of the combined asset value.
