Need For Enactment Of Space Laws In India
LawZ Magazine|February 2018

SPACE is a word beyond imagination for any layman who is fascinated by the glimpse of the stars at night and baffled at the very knowledge of how the celestial ingredients of the universe maintain their strict discipline, obeying the nature ordained laws. Many space landings and explorations have raised the eyebrows in surprise and what seemed impossible ageing times before, is now an area of interest, for people who believe in the mesmerizing beauty and treasure of the universe.

Need For Enactment Of Space Laws In India

Right from Galileo making a telescope to launching of the communication satellites and space shuttles, the space industry has traveled a long way. Nations, as they progress with space commercialization and explorations, must also be geared up to wear the attires of more rights and liabilities. There is a need for India to enact codified laws relating to the outer space, which may provide solutions to the problems that are faced by the institutions dealing with research and exploration, and also to supervise the issues raised by the private companies, which provide the resources and launching services.

India is preparing a platform to come at par with the other space agencies, and learn from their policies and methods of research and development. The ambitions of the Indian space agencies can be realized from its first unmanned scientific mission to moon Chandrayaan-I. India has space cooperative agreements with countries like USSR on Thumba Equatorial Rocket Launching Station, German Aerospace Centre, National Institute of Aeronautics and Space etc. In India, the matters related to space activities are dealt by the Space Commission which works for the development and application of space technology, along with drafting of policies and guidelines for the research institutes. Issues related to space must also be transferred from Concurrent list to Union list and put under direct control of central government.

Builders Can't Force Buyers To Go For Arbitration

It is a well settled law that arbitration agreements do not bar the jurisdiction of the National Consumer Disputes Redressal Commission (‘NCDRC’) and other consumer forums. The issue was, however, reconsidered at length by a Full Bench of the NCDRC, in Aftab Singh v Emaar MGF Land Limited &Anr [Consumer Case No 701 of 2015] in view of the amendments to the Arbitration and Conciliation Act 1996 (‘the Amended Act’).
