In a welcome move, the Supreme Court rules that 1,528 alleged fake encounters over the last 20 years must be investigated.
On 8th July, the Supreme Court held that the armed forces cannot use excessive force even in areas that come under the Armed Forces Special Powers Act (AFSPA) and ruled that 1,528 cases of alleged fake encounters in Manipur, over the last 20 years, must be investigated.
This landmark announcement has come about in the wake of an earlier petition filed in 2012 by Extra Judicial Execution Victim Families Association and Human Rights Alert, Imphal seeking a detailed investigation into 1,528 documented cases of alleged fake encounters in Manipur.
The recent observations by the Supreme Court will naturally meet many ‘reservations’ from the Defense forces who will argue that its personnel will need the ‘protection’ provided by AFSPA (read total impunity) in the course of its counter insurgency measures in Manipur and elsewhere. And while it will take a long time for things to change on the ground, there is no denying that this validation from the highest court in the country heralds a subtle shift in terms of the view on AFSPA and the manner in which it wrecks the lives of people.
