Jain: Can't let probe agency 'browbeat' judge, seek transfer over bias

Jailed minister Satyendar Jain on Wednesday urged Delhi High Court to "protect the judge" who was earlier hearing his bail plea. Challenging the decision of the district judge to allow Enforcement Directorate's (ED) plea to transfer his bail plea to another judge, Jain argued that the probe agency couldn't be allowed to "browbeat" a judge and seek transfer on the basis of a "bias".

ED is not a common man. It is an uncommon species ruling the country, senior advocate Kapil Sibal, appearing for Jain, remarked. He contended that not stopping ED's conduct would bring anarchy, and asserted that the bias suddenly dawned on the agency after the special court judge did not agree to its request for constituting an independent board for Jain's medical examination. Your lordship will have to decide whether the judge is to be protected or ED is to be protected. It is time for the judiciary to stand up and say these kinds of tactics cannot be accepted. You cannot allege bias against a judge, Sibal argued.
