A bench of the Gujarat High Court, comprising Justice Biren Vaishnav and Justice Maulik Shelat, has delivered a significant ruling on the legal validity of divorce deeds. The court declared that unless a prevailing societal custom supports such a practice, a legally-wedded husband and wife cannot separate or divorce through the execution of a notarised divorce deed. Even if such practices are unknowingly adopted, no court can legitimise them by granting its approval.
